INFORMATION ABOUT THE PROTECTION OF PERSONAL DATA

We attach great importance to ensuring the security of the personal information you have given to us, both when using our website and through other means. The law currently in force regarding this matter is the “Personal Data Protection Law” No. 6698. We would like to inform you about the aforementioned legislation and a part of the definitions specified in this legislation:

Personal data: Any information relating to an identified or identifiable natural person,

Processing of personal data: Any operation which is performed upon personal data such as collection, recording, storage, preservation, alteration, adaptation, disclosure, transfer, retrieval, making available for collection, categorization, or blocking its use by wholly or partly automatic means or otherwise than by automatic means which form part of a filing system,

Data processor: Natural or legal person who processes personal data based on the authority granted by and on behalf of the data controller,

Filing system: Any recording system through which personal data are processed by structuring according to specific criteria,

Data controller: Natural or legal person who determines the purposes and means of the processing of personal data, and who is responsible for establishment and management of the filing system.

  1. Purpose of Protection of Personal Data and Consent Text and the Position of Our Company as the Data Controller:

Our online store has the “data controller” title within the scope of the Law on the Protection of Personal Data No. 6698 (“Law”) in terms of the personal data of the customers, whereas pursuant to the Law on the Protection of Personal Data and the Consent Text, it is hereby intended to inform the customers about the personal data processing activities carried out by our shopping website and to obtain their explicit consent for the situations set out in the above Article 3.

  1. The Personal Data to be Processed in Line with the Explicit Consent of the Customers and the Purpose of Processing:

In the following cases where the personal data processing requirements set out in Articles 5/2 and 6/3 of the Law cannot be met, it is required for our shopping website to obtain the customers’ explicit consent.

  1. Purpose of Processing the Personal Data of the Customers:

The personal data of the customers are processed within the framework of the conditions and purposes of personal data processing that are set out below and in Articles 5 and 6 of the Law and in line with the Customer’s consent and may be shared with the parties specified in this Protection of Personal Data Text.;

  • To carry out necessary works and relevant business processes by the respective business units to ensure the benefit of respective individuals from the products and services offered by our shopping website,
  • To carry out necessary works and relevant business processes by the respective business units for the commercial activities of our shopping website to be realized,
  • To plan and execute the commercial and/or business strategies of our shopping website,
  • To provide the legal, technical, and commercial-business safety of the individuals who are in a business relationship with our shopping website and to plan and execute the activities required to recommend and promote the products and services offered by us to the relevant individuals by customizing them according to their liking, habits of use and needs,
  • To establish the potential claims of rights and receivables of the respective persons
  • To inform competent authorities according to the legislation
  • To create and follow up the visitor records
  • To ensure the fulfillment of obligations within the scope of the Consumer Protection Law, the Law on the Regulation of Retail Commerce, and other legislations by our Company and our branches, call centers, and affiliates on behalf of our Company, through all channels including but limited to our websites and social media accounts,
  • To provide our customers with better services, various advantages, information on sales, marketing, and promotions, information on campaigns and their terms and conditions, to conduct questionnaires and customer satisfaction surveys, to provide and speed up your purchasing procedures and to collect and deliver your orders,
  • To create campaigns for customers, to make cross-sales, to specify a target audience,
  • To carry out activities user experience increasing activities by tracking the customer activities, to develop the website and mobile application of our shopping website and to customize the same according to the needs of the customer, to carry out personalized marketing and re-marketing activities, to carry out personalized segmentation, targeting, analysis and in-house reporting activities and market researches,
  • To plan and execute the products and/or services of our shopping website including the planning and execution of customer satisfaction activities and the planning and execution of customer relations.

Our Shopping Website reserves the right to define the marketing lists that are based on the metrics such as associating the in-site behaviors of the visitors of the website, even if they are non-member visitors, with a cookie in the browser and with the number of viewed pages, the visiting time and the number of target completions. Then, targeted advertising content may be shown to this user on the site or other sites in the Display Network, based on the interests of the users. During the redirection of Google AFS ads to our Shopping Website, Google may place cookies on users’ browsers or read the cookies contained in them or use web beacons to collect information.

 

  1. Transfer of Personal Data of Customers:

The Personal Data of Customers may be shared with the Company employees, our affiliates, business partners, suppliers, shareholders, officially authorized institutions and organizations within the framework of the personal data processing conditions and purposes specified in Article 8 and 9 of the Law including ensuring our business units to carry out necessary studies for the respective individuals to benefit from the products and services offered by our shopping website and to perform necessary business processes, ensuring the respective business units to perform necessary  studies to realize the commercial activities of our shopping website and to perform the associated business processes, planning and executing the commercial and/or business strategies of our shopping website, providing the legal, technical and commercial-business security of our shopping website and the respective persons who are in a business relationship with our shopping website and planning and executing the activities required for the recommendation and promotion of the products and services offered by our shopping website to the respective individuals by customizing them according to their likings, habits of use and needs.

The User’s Name and Contact Information may be shared with payment institutions for identity verification pursuant to the payment institution framework agreement to be approved at the payment stage and according to the Regulation on the Prevention of Laundering of Crime Revenues and Financing of Terrorism, published in the Official Gazette No 26751 dated 9 January 2008.

Our Shopping Website will be able to transfer personal data to third parties within the country as well as abroad, provided that the conditions stipulated in the Law No. 6698 are met within the scope of the aforementioned purposes.

  1. Method and Legal Grounds of Personal Data Collection:

Personal data is collected electronically from customers. Personal data collected for the aforementioned legal grounds can be processed and transferred for the purposes specified in Articles 5 and 6 of the Law and this Personal Data Protection Text.

  1. Retention Periods of Personal Data

Our Shopping Website retains personal data for the period specified in these legislations and in cases where stipulated in the relevant laws and regulations.

If a period for retaining personal data is not specified in the respective legislation, the Personal Data is processed for a period that requires it to be processed according to the practices of our Shopping Website and the practices of its commercial life, depending on the activity carried out while processing that data, and then deleted, destroyed or is made anonymous.

If the purpose of processing personal data has ended; if the retention periods specified by the relevant legislation and our Shopping Website have also expired; Personal data may only be stored to provide evidence in case of possible legal disputes or to make a claim related to personal data or to establish a defense. The retention periods herein are specified based on the prescription periods for claiming the aforementioned rights and the examples in the previous claims directed at our Shopping Website regarding the same matters even though the prescription periods were expired. In this case, the retained personal data is not accessed for any other purpose, whereas the respective personal data is allowed to be accessed only when it is necessary to use it in the relevant legal dispute. Personal data is deleted, destroyed, or anonymized after the aforementioned period expires.

  1. Rights of the Customer as the Personal Data Subject:

Pursuant to Article 11 of the Law, the data subjects have the right to; (i) learn whether personal data about them is being processed, (ii) request information if their personal data has been processed, (iii) learn the purpose of processing their personal data and whether they are used according to the intended purpose, (iv) know the third parties in the country or abroad to whom their personal data is transferred, (v) request correction of personal data in case of incomplete or incorrect processing and to request for the transaction made within this scope to be notified to the third parties to whom personal data has been transferred, (vi) request the deletion or destruction of personal data in case the reasons requiring it to be processed cease despite the fact that it has been processed according to the provisions of the Law and other relevant laws, and to request for the transaction made within this scope to be notified to the third parties to whom personal data has been transferred, (vii) object to the emergence of a result against the data subject arising from the analysis of the processed data exclusively by using automatic systems, and (viii) claim the compensation of the damage in case of loss due to unlawful processing of personal data.

The requests regarding the exercise of the aforementioned rights may be conveyed by the data subjects to our Shopping Website, through the methods specified within the scope of Law No. 6698. Our shopping website will evaluate such requests and conclude them within 30 days.

The matters mentioned in this form may be amended in line with the legal and technological developments.
